CONSTITUTION OF THE ROSE-HULMAN GUN CLUB




ARTICLE I


NAME


The name of this organization shall b the Gun Club of Rose-Hulman Institute of Technology.



ARTICLE II


PREAMBLE


We, the members of the Rose-Hulman Gun Club, knowing that no organization can prosper without the cooperation and involvement of its members, do hereby establish this constitution as the club's foundation. This constitution will serve as a guide for the club's organization and for the activities that the club members pursue. The Gun Club's purpose is to provide a means by which Rose-Hulman students can work together to safely pursue their common interests in firearms and marksmanship.



ARTICLE III


GOVERNMENT


Section 1 – Officers


The elected officers of the club shall be a President, a Vice-President, a Treasurer, and an Ordnance Officer to be elected as specified in the Bylaws.


Section 2 – Term of Office


All officers shall serve a term beginning on the day following elections. This term will end the day the successor takes office.


Section 3 – Nomination of Elected Officers


Any member of the Gun Club in good standing and meeting all the requirements as stated in the Bylaws shall be eligible for nomination.


Section 4 – Presiding Officers


A. The presiding officer shall always be the President.


B. If the President is unable to do so or if he requests so, rank of the presiding officer shall be the Vice- President, then the Treasurer, and then the Ordnance Officer.


Section 5 – Duties of the Officers


A. The duties and powers of the President shall be as follows:

  1. To serve as chairman at meetings of the officers.

  2. To preside at general meetings of the Gun Club.

  3. To represent the Gun Club at all functions, on all occasions and at all ceremonies where such representation shall be deemed necessary, required or desired.

  4. To serve as spokesman to all entities not associated with the Gun Club.


  1. To make recommendations for legislation or other action to the general membership when deemed necessary

  2. To supervise, assist, and when necessary, require reports from the other officers.

  3. To compile and present, along with the Treasurer, the annual budget request to SGA.

  4. To appoint a Secretary, Public Relations Officer, and Faculty Advisor (if needed) within one week of being elected.

  5. To perform each and every other duty usual, customary, or required of the presiding officer of any organization.


B. The duties and powers of the Vice-President shall be as follows:

  1. To assume and perform all duties of the President in the event of his absence or incapacity or as requested by the President.

  2. To audit the books and accounts of the Treasurer at the close of the school year and submit a report to the President

  3. To perform applicable duties as associated with membership firearms familiarization, and safety instruction.

  4. To perform any and all other duties which may, from time to time, be delegated to him or requested of him by the President.


C. The duties of the Treasurer shall be as follows:

  1. To maintain an accurate and true written record of all funds of the Gun Club.

  2. To handle all financial matters of the Gun Club to include making disbursements when so authorized by the club or its President.

  3. To collect dues and shooting fees, and maintain an accurate list of paid members.

  4. To compile and present, along with the President, the annual budget request to SGA.

  5. To submit a written monthly report summarizing the Gun Club's financial activity and current situation to the other officers.


D. The duties of the Ordnance Officer shall be as follows:

  1. To perform applicable duties as associated with all ordnance and reloading.

  2. To perform any and all duties which may from time to time, be delegated to him or requested of him by the residing officer.


Section 6 – Office of the Secretary


A. The duties of the secretary shall be to keep the minutes and records of all official meetings of the Gun Club or its officers, to prepare all written correspondence for the President and to keep an up-to-date list of active members.


B. The Secretary will be appointed by the President within a week after his election. His term will begin immediately and will end when his successor takes office.


Section 7 – Public Relations Officer


A. The duties of the Public Relations Officer shall be to act as a liaison between the Gun Club and other organizations and to coordinate any non-shooting activities of the club.

ARTICLE IV


ADVISORY CAPACITY


Section 1 – Appointment of Faculty Advisor


A faculty advisor(s), who shows genuine interest in the Gun Club and is experienced with firearms or willing to learn will be appointed if necessary by the President (within one week of his election) subject to approval of the other officers and the Dean of Students.


Section 2 – Dismissal of Faculty Advisor


The faculty advisor(s) may be dismissed from the position if his actions become detrimental to the Gun Club. This is accomplished through the unanimous vote of the officers and a two-thirds (2/3) or more vote of a quorum of the active general membership at a meting called for such a purpose. It must then be approved by the Dean of Students.


Section 3 – Powers and Duties of the Faculty Advisor


A. To advise the officers, when necessary, on any action or decision made by them, at his discretion or upon request.


B. A faculty advisor shall have a vote in any Judicial Review.


C. A faculty advisor shall have a vote in every decision open to the general membership.


Section 4 – Veto Power of the Faculty Advisor

A. A faculty advisor to the Gun Club has the power to overrule any decision made by any voting body of the club.


B. This veto power is to be used only if a decision made by such voting body would be detrimental to the Gun Club, Rose-Hulman Institute of Technology, or if such a decision is deemed unlawful or dangerous by the faculty advisor.


C. Written notification must be given to the Dean of Students within one week of the veto explaining the circumstances of the veto.


D. A veto by a faculty advisor can be overruled only by the Dean of Students.



ARTICLE V


MEMBERSHIP


Section 1 – Eligibility


Any student in good standing of Rose-Hulman Institute of Technology and of the Gun Club shall be eligible for membership.


Section 2 – Active Membership


A. Any member of the Gun Club who has paid the required dues, attended the annual safety briefing, and who is not on probation with the club, and who has signed the Liability Waiver designated by the president, and who is considered an active member.


B. All members on the club's membership list for less than one quarter are considered probationary (non- active) members. This status drops after one quarter of participation.

C. Any member of the Gun Club may be placed on probation after a Judicial Review as stated in ARTICLE VI. This status will remain in effect until all the requirements set forth by the voting members of the Judicial Review are satisfied.


Section 3 – Voting Rights


Any active member of the Gun Club shall have the right to participate in any vote of the general membership. All active members are given only one vote.


Section 4 – Veto Power of the General Membership


A. Any decision or vote of the Club Officers can be nullified and/or reversed by the general membership under the following conditions:

  1. No more than 2 meetings of the general membership have passed since said decision or vote was made.

  2. The majority of a quorum of the active members vote against said decision or vote at a meeting of the general membership.

  3. A decision or vote is nullified only if it was passed.

  4. A decision of vote is reversed only if it was not passed.


B. If such decision or vote is nullified by the general membership, it is as if such decision or vote was never made and all previous decisions or votes which were superseded by the nullified one are now considered binding and in full force.


C. If such decision or vote is reversed by the general membership, it is as if said decision or vote was passed and it is now considered in full force and becomes bound in the Bylaws (if applicable.)


Section 5 – Meeting Attendance


Members are required to attend meetings. Members who have an unexcused absence may face restrictions in club activities if deemed appropriate by others. An unexcused absence results from failing to notify the Secretary of your conflict before the meeting.


Section 6 – Procedures for the Judicial Review


A. An unanimous vote by the review shall be necessary to render the Review's decision effective.


B. The defendant shall have the opportunity of defending himself against the charge at the hearing.


C. All decisions may be appealed to the Dean of Students.


Section 7 – Dues


Dues will be collected by the Treasurer at the second general meeting and anytime afterward. Dues are placed into the Club's account and are used to pay for the club activities and equipment. The amount of dues for the following year is determined at the general meeting held during eighth week of spring quarter after the new officers have been elected.


Section 8 – Quorum


A quorum of the Gun Club shall consist of one-half (½) of the active general membership present at any regular or special meeting thereof.


Section 9 – Vote Requirements


All votes unless specifically specified otherwise, shall be passed by two-thirds (2/3) of a quorum of the active general membership of the Gun Club.



Section 10 – Amendments to the Bylaws


Amendments to the Bylaws will be handled as Constitutional amendments as outlined in Article VII with the exception that only a quorum of active members is required for voting purposes or to delay the vote.



ARTICLE VI


THE JUDICIARY


Section 1 – Judicial Powers


All judicial powers of the Gun Club shall be vested in the elected officers.


Section 2 – Jurisdiction of the Judicial Review


A. The Judicial Review shall have jurisdiction over any violation of this Constitution and it's Bylaws as well as any member conduct deemed detrimental to the Gun Club.


B. Any case of member misconduct which is or may be detrimental to the Institute shall be brought to the attention of the Dean of Students who shall determine the action to be taken.


Section 3 – The Inquiry


A. The inquiry is a brief meeting of the elected officers and the faculty advisor(s) to determine the validity of a charge raised against a member with regard to his association with the Gun Club and, if necessary, to set a time and date for a Judicial Review.


B. If the defendant is an elected officer, he may not be present during the inquiry.


C. Written notice of a Judicial Review shall be given to the plaintiff, the defendant, th faculty advisor(s) and the elected officers at least 7 days in advance of the scheduled date.


Section 4 – The Judicial Review


The Judicial Review shall consist of the plaintiff, the defendant, the faculty advisor(s) and the elected officers. Neither the plaintiff or the defendant maybe a voting member of the Review. The voting members of the Review shall have the power to determine all other procedures not inconsistent herewith. The procedures of the Judicial Review shall be set forth in the Bylaws.



ARTICLE VII


AMENDMENTS


Section 1 – Submitting an Amendment


Any proposed amendment shall be submitted in writing by any active member of the Gun Club to the President.


Section 2 – Voting Process for an Amendment


A. Such amendment shall be read before the general membership at the next meeting of that body. After such amendment has been read and explained, there shall be a discussion period not to exceed fifteen (15) minutes in length after which a vote shall be taken. A vote may be delayed until the next general meeting if one-third (1/3) of the voting members wish a delay.


B. Should the vote recorded for the adoption of the amendment be less than two-thirds (2/3) of the entire active membership of the Gun Club, such amendment shall fail and no consideration will be given to it for a full year.


C. Should the vote recorded for the amendment be two-thirds (2/3) or more of the entire active membership of the Gun Club, such amendment shall be considered in effect and shall be added to and become a part of the Constitution of the Gun Club of Rose-Hulman Institute of Technology.



ARTICLE VIII


ADOPTION AND REPEAL


This Constitution and Bylaws shall be considered adopted when and if two-thirds (2/3) of the entire active membership of the Gun Club of Rose-Hulman Institute of Technology vote to adopt said Constitution at a meeting called for such purpose.


Upon the adoption of this Constitution and Bylaws of the Gun Club of Rose-Hulman Institute of Technology, all previous Constitutions and Bylaws, including any and all amendments thereon or thereto, shall be considered codified herein or repealed.
